Can I sue somebody for using my checks as fraud?
About 2 years ago I threw away my checkbook without tearing it up. Two people got ahold of my checks and tried to clear 10 checks of 500 dollars or more through the account because they forged my signature and tried to cash all of them at a bank. I filed a police report for fraud but I am wondering if I can sue the two people that used my checks.
You can sue if you were harmed. Your use of the phrase “tried to cash” implies that they didn’t succeed. If the bank protected you by not cashing the checks, or by refunding the money to your account after the fraud was discovered, then you have suffered no loss and have nothing to sue for.
